FEDERAL CRIMINAL APPEALS & FEDERAL POST-CONVICTION
For almost eight years, Ms. DaCruz served as an Appellate Attorney and Assistant Federal Public Defender at the Federal Defenders Office, Middle District of Florida. While working at the Federal Defenders Office, Ms. DaCruz represented hundreds of clients who were charged and/or convicted of various federal criminal offenses including: drug conspiracy/trafficking; MDLEA; Wire Fraud; Counterfeiting; Illegal ReEntry; Fraud; and Possession of a Firearm by a Convicted Felon offenses. Ms. DaCruz also litigated sentencing enhancement issues and various appellate issues from complex/lengthy federal criminal trials.
If you have been convicted of a federal criminal offense, Ms. DaCruz is prepared and ready to assist you with your federal criminal appeal in the Eleventh Circuit Court of Appeals or pro hac vice in another federal circuit. There is no federal case or appellate issue that is too complex for Ms. DaCruz to challenge and litigate before the federal appellate courts.
Further, Ms. DaCruz represented hundreds of clients pursuant to federal retroactive crack cocaine drug guideline Amendment 706 and Amendment 750 in the federal district courts through the Supreme Court of the United States. Ms. DaCruz handled the majority of the retroactive crack cocaine sentencing guideline amendment cases in the Middle District of Florida, which had the second highest numbers of federal crack cocaine convictions in the country (0ver 1500 convictions). Ms. DaCruz remains passionate about litigating federal crack cocaine sentences that unfairly affected primarily black defendants with disproportionately harsher federal prison sentences compared to federal powder cocaine sentences. Ms. DaCruz continues to actively litigate this issue by representing clients for First Step Act and Compassionate Release Motions (and hopefully soon, The EQUAL Act!).
FLORIDA CRIMINAL APPEALS/FLORIDA POST-CONVICTION
Ms. DaCruz has also served as an Appellate Law Clerk and Central Staff Attorney at the Florida Fifth and Fourth District Courts of Appeal and as a Trial Court Staff Attorney in the Eighteenth Judicial Circuit in Seminole County, Florida. Ms. DaCruz can represent you for Florida direct criminal appeals and Florida post-conviction appeals. Ms. DaCruz also handles Florida post-conviction motions (Rule 3.850; 3.853; Manifest Justice Habeas) in the Circuit Courts.
In addition to handling appellate and criminal defense litigation, Ms. DaCruz is an adjunct professor at Palm Beach State University where she has taught Legal Writing and Research II and Criminal Litigation. Ms. DaCruz is also the owner of Esquire Wellness, LLC, where she promotes attorney wellness, presents attorney wellness seminars and CLEs, and designs law firm wellness programs.
